1. Agreement

These Terms of Service ("Terms") govern your use of Bird Whisperer ("Service"), operated by Kitchen Rodeo LLC ("Company", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

Bird Whisperer is a subscription service that generates AI-powered daily email digests summarizing public posts from X/Twitter accounts you select. The Service fetches publicly available posts, processes them using artificial intelligence, and delivers summaries via email.

3. Eligibility

You must be at least 18 years old and capable of entering into a binding agreement to use the Service. By using Bird Whisperer, you represent that you meet these requirements.

4. Accounts

You are responsible for maintaining the security of your account and email address. You must provide accurate information when creating your account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription & Billing

Bird Whisperer offers a 7-day free trial followed by a paid subscription. Current pricing is available on our website. Billing is handled by our payment processor. By subscribing, you authorize recurring charges to your payment method. You can cancel at any time through your account settings; access continues through the end of the current billing period.

We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.

6. Acceptable Use

You agree not to:

• Use the Service to monitor private accounts or non-public content
• Redistribute, resell, or commercially exploit digest content
• Attempt to circumvent usage limits or access controls
• Use the Service for harassment, stalking, or any unlawful purpose
• Interfere with or disrupt the Service's infrastructure

7. Content & AI Summaries

Digests are generated by artificial intelligence and may contain inaccuracies, omissions, or misinterpretations of the original posts. Summaries are provided for informational convenience only. We do not guarantee the accuracy, completeness, or reliability of AI-generated content. Always refer to the original posts for authoritative information.

The original posts summarized in digests remain the intellectual property of their respective authors.

8. Third-Party Services & Tools

The Service relies on third-party services and tools to operate, including but not limited to social media APIs, AI and machine learning providers, cloud infrastructure, email delivery services, and payment processors. We may change, add, or remove third-party providers at our discretion to improve the Service, without notice. Your use of the Service constitutes acceptance of the terms of any third-party services we use to deliver it.

9. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted availability. The Service depends on third-party APIs and services which may experience outages or changes outside our control. We will not be liable for missed or delayed digests due to third-party service disruptions.

10. Modifications to the Service

We reserve the right to modify, update, or discontinue any aspect of the Service at any time, including the AI models, data sources, infrastructure providers, and features used to deliver digests. We will make reasonable efforts to notify you of material changes.

11. Limitation of Liability

To the maximum extent permitted by law, Kitchen Rodeo LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Termination

You may cancel your subscription and delete your account at any time. We may terminate or suspend your access for violation of these Terms with or without notice. Upon termination, your data (follows, settings, digest history) will be permanently deleted.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of New York County, New York.
